About these terms

These terms apply to the HeyPlane Apple Watch app, its iPhone companion app, the HeyPlane service the apps use and this website. HeyPlane is provided by Mario Anderhub (“we”). The apps are licensed to you under Apple’s Licensed Application End User License Agreement. These terms add to it and also cover the HeyPlane service and this website. Where the two differ, these terms apply, including the liability rules below. By using HeyPlane you agree to both. You can read these terms at any time at heyplane.app/terms.

Not for navigation or safety

HeyPlane shows approximate, near real-time aircraft information for general interest. It is not an aviation, navigation, air traffic or safety tool. Do not rely on it to make decisions where accuracy matters, for example about flying, drones, travel plans or anyone’s safety.

Data accuracy and coverage

Aircraft positions come from a community network of receivers, through our data provider. Details such as type, airline and route come from public reference data and are shown only when we can match them. All of this may be delayed, incomplete, out of date or wrong. Coverage depends on where receivers are and varies by region; an empty map does not mean the sky is empty. Some aircraft are not shown at all.

Sources and trademarks

The apps show notices for the data sources they use. Aircraft position data is from ADSB.lol under the Open Database License (ODbL). Aircraft types, airlines and countries come from Virtual Radar Server standing data (CC0). Airline icons come from the Soaring Symbols project (MIT). Aircraft photos come from Planespotters.net; each photo belongs to the photographer credited with it. Maps are provided by Apple.

Airline names and logos are trademarks of their owners and are shown only to identify the airline. HeyPlane is not affiliated with or endorsed by any airline, airport or data provider. Apple and Apple Watch are trademarks of Apple Inc.

Using HeyPlane fairly

Please don’t:

• access the HeyPlane service other than through the HeyPlane apps, or copy, scrape or resell its data;
• try to overload, disrupt or get around the limits or security of the service;
• use HeyPlane in a way that breaks the law or harms other people.

We may limit or block access that does any of these things.

Availability and changes

HeyPlane is currently free. We may add optional paid features later; any purchase would be made through the App Store under Apple’s terms, and we would tell you the price before you buy. We work to keep the service running but can’t promise it will always be available or free of errors. We may change, pause or end features or the service.

Liability

HeyPlane is provided free of charge. We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, for defects we have fraudulently concealed or given a guarantee for, and under the German Product Liability Act.

For slight negligence, we are liable only if we breach an essential obligation, meaning one that makes proper use of HeyPlane possible in the first place and that you may regularly rely on, and then only for damage that is typical and foreseeable for a free service like this. Otherwise we are not liable for slight negligence. Because HeyPlane does not promise that aircraft information is accurate or complete (see “Not for navigation or safety”), information that turns out to be late, incomplete or wrong is not a breach of an essential obligation.

These rules also apply to anyone who helps us provide HeyPlane. Your statutory rights as a consumer remain unaffected.

Governing law

These terms are governed by the law of the Federal Republic of Germany, without affecting any mandatory consumer protection rules of the country where you live. If you are a consumer, you can also bring a claim before the courts where you live.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

Changes to these terms

We may update these terms for the future, for example when we add a feature or the law changes. We will change the date at the top and announce important changes on this page before they take effect. The version shown here when you use HeyPlane applies to that use. A change never applies to the past, and never changes the terms of a purchase you have already made unless you agree.
